These terms and conditions (“Terms”) apply to the Analytic Design Online Course & Community for Online Business Optimization provided by Analytic Design, 7600 Ora Glen Dr.
The agreement for you to participate in the Analytic Design Online Course & Community for Online Business Optimization is when payment is received either in full or for the first month of the appropriate installment option, and is governed by these Terms & Conditions until it ends in accordance with these Terms.
We will provide the Services with reasonable care, skill and ability. Apart from that, all warranties and representations are excluded to the fullest extent permitted by law. Due to the nature of coaching, we cannot and do not guarantee any particular results.
When participating in the Analytic Design Online Course & Community for Online Business Optimization, information you share and your behavior towards other participants will be polite, respectful and not offensive. Offensive or hostile behavior towards or in relation to other participants is not permitted.
You will not post material or make comments that are likely or intended to be or are in breach of any person’s rights, defamatory, obscene, sexually explicit, discriminatory, violent, threatening, promoting illegal activity, or are likely or intended to deceive any person, or harass or cause anxiety to any person, or likely to bring us into disrepute.
Analytic Design reserves the right to change the content of the Analytic Design Online Course & Community for Online Business Optimization at any time without notice with the intention to provide more value.
Protection of Services
1. You agree not to reproduce, copy, sell, trade, resell or exploit for any commercial purpose any aspect of the Services or any associated materials.
2. You acknowledge and confirm that all intellectual property and other proprietary rights in materials provided in connection with the Services, including without limitation copyright and any rights in designs, are owned by Analytic Design or my licensors and that you shall not acquire any rights in such materials, use them for any commercial purpose or carry out any action inconsistent with such ownership.
3. Should you become aware of any actual or threatened infringement by any person of the intellectual property and proprietary rights, you undertake to inform Analytic Design at once in writing to hello@analyticdesign
Liability and Indemnity
1. Analytic Design’s liability to you in connection with the Services (including, without limitation as a result of any breach of these Terms & Conditions or negligence) shall be limited to the level of the Charges actually paid by you to me under these Terms & Conditions.
1.1 Analytic Design does not accept any liability whatsoever for:
1.1.1 Any consequential or indirect losses, loss of profit, business, goodwill and/or anticipated savings;
1.1.2 Any failure or delay in performing the Services to the extent arising from any matter beyond reasonable control;
1.1.3 You undertake to indemnify Analytic Design and any person(s) acting on her behalf in connection with the Services for any and all losses, costs, claims or demands suffered by her or them arising as a result of your acts or omissions.
1.1.4 The limitations of liability in this clause apply to Tanya Amaya and all person(s) acting on the company’s behalf including without limitation Tanya Amaya personally. However, nothing in these Terms & Conditions shall limit the liability of any person in respect of any matter for which it is not possible to limit liability at law.
Conduct
You undertake to behave professionally, courteously and respectfully in all dealings with Analytic Design, any person(s) acting on behalf of the company and any other clients or other third parties to whom you may be introduced in connection with the Services, to adhere to any program rules which may be provided from time to time and not to carry out any action intended or likely to bring me or the Services into disrepute.
Disclaimers
You acknowledge that the Services involves education, personal and technical development, that their effect depends on your own level of engagement and commitment and that no specific results can therefore be guaranteed by Analytic Design. Tanya Amaya accepts no responsibility for any decisions made by you as a result of the Services.

Membership Fees
Fees for the Analytic Design Online Course & Community for Online Business Optimization are $169 monthly without an applied discount, referral program or bonus code.
Refund Policy
We believe in the power of this course when done properly. If however you do not find value in it, you can stop your membership at any time. Once stopped any services or tools in use will be the
Confidentiality and Non-Disparagement
Each of us shall keep confidential all sensitive information relating to the other, and the other members of the group and my/their business (which in my case includes materials provided in connection with the Services) and not use such information for any purpose other than that for which it was provided. This shall not apply to the extent that any information is required to be disclosed by law or by any court or public body having binding authority to require such disclosure.
We each agree not to engage in any conduct or communications, public or private, intended or likely to disparage the other (or other members of the Community) or damage their interests.
Breach of Contract
We will not be in breach of the Contract nor liable for failure to provide services or perform obligations where it is not reasonably practicable to do so due to acts, events, omissions, accidents or circumstances beyond control.
This entire clause, including this paragraph, shall survive termination of the Contract.
